Restaurant Booking Terms and Conditions
These terms (“Booking Terms”) apply to restaurant reservations and offers made through tabledeals.co.za (the “Website”), operated by [TBC: company legal name] (Pty) Ltd (“we”, “us”, “our” or “Table Deals”), in South Africa. They should be read together with our Website & Platform Terms of Use and our Privacy Policy.
1. Booking Confirmation
Your booking is confirmed when the platform issues a booking confirmation. The confirmation records the restaurant, date, time, number of diners and applicable offer.
2. Arrival and Check-in
- Please arrive at the booked restaurant at the confirmed time and identify yourself as a platform booking customer.
- Unless the restaurant confirms otherwise, a grace period of 15 minutes may apply. This is a policy, not something the Website automatically enforces or times.
- Late arrival may affect the restaurant's ability to honour the booking or offer, particularly where the restaurant has released the table.
3. Offer
- Any discount or special offer applies only as stated in the booking confirmation.
- Beverages, service charges and other exclusions will be treated as stated in the confirmation or restaurant terms.
- Offers generally cannot be combined with other promotions unless expressly permitted.
- The restaurant controls its menu, seating arrangements and operational requirements.
4. Number of Diners
The offer applies to the number of diners recorded on the booking confirmation. Before you complete payment, you can change the party size yourself on the Website. Once a booking is confirmed, the Website does not currently support changing it yourself; contact our support team at [email protected] before arrival and we'll assist directly. The restaurant may decline to apply the offer if the changed party size falls outside the offer conditions.
5. Group and Large-Party Bookings
Bookings above the group size stated by a Restaurant (typically 8 or more guests) may be subject to a minimum spend, a pre-authorisation hold, a set menu, or a discretionary service charge. These are requirements the individual Restaurant sets and communicates to you directly, not something the Website itself manages or charges. Clause 6 (Changes, Cancellations and Refunds) applies equally to group bookings.
6. Changes, Cancellations and Refunds
You have a right under section 17 of the Consumer Protection Act 68 of 2008 (“CPA”) to cancel any advance booking made through the Website.
We or the Restaurant may require payment of a reasonable cancellation fee if you cancel, as permitted by section 17(3) of the CPA. A cancellation fee will not be reasonable if it exceeds a fair amount having regard to: (a) the nature of the goods or services booked; (b) the length of notice of cancellation you give; (c) the reasonable potential for the Restaurant, acting diligently, to fill the table or find an alternative customer between receiving your cancellation notice and the booked time; and (d) general practice in the restaurant industry.
No cancellation fee will be charged where you are unable to honour a booking because of the death or hospitalisation of the person for whom, or for whose benefit, the booking was made, as required by section 17(5) of the CPA. We may reasonably ask for supporting information.
No-shows: if you do not arrive and have not cancelled in advance, your booking fee may be forfeited, applying the same reasonableness factors set out above.
Refunds: where you are entitled to a refund under this clause 6 or applicable law, we will process it within 10 business days of the refund being approved, using your original payment method unless we agree otherwise with you. Today, refund requests are reviewed and processed manually by our support team rather than issued automatically, but we aim to meet this timeline in every case.
Where a Restaurant cannot honour a confirmed booking for a reason attributable to the Restaurant or the platform, we will offer, in order of preference: (a) an alternative booking or a reasonable substitute; or (b) a full refund of any amount paid, together with any other remedy required by applicable law.
Nothing in this clause 6 removes any right to a refund or cancellation that cannot lawfully be excluded under the CPA or other applicable law.
7. Restaurant Information
Restaurant menus, prices, photographs, operating hours and other information are supplied by restaurants or other sources. We take reasonable steps to keep this information accurate but cannot guarantee that every item is current. If there is a genuine discrepancy between the Website and what the Restaurant offers on arrival, the Restaurant's own menu and terms at the venue will prevail, without prejudice to any remedy you may have against the Restaurant or us for that discrepancy.
8. Allergies, Dietary Requirements and Food Safety
The Restaurant, not Table Deals, is the supplier of the food and beverages served to you and is solely responsible for their quality, safety and suitability, including compliance with the Foodstuffs, Cosmetics and Disinfectants Act 54 of 1972 and the applicable provisions of the CPA.
You must inform the Restaurant directly of any allergies or dietary requirements before ordering. Restaurants may not be able to guarantee an allergen-free environment. The platform is not a substitute for direct communication with the Restaurant's kitchen or waitstaff.
Nothing in this clause excludes any liability that cannot lawfully be excluded under the CPA, including liability for harm caused by unsafe food or a failure to give an adequate warning of a known risk.
Restaurants agree to indemnify us against claims arising from food safety, allergens, hygiene or service quality at their venue. We are not liable for these matters, except to the extent a claim arises from our own negligence, for example materially misrepresenting allergen information a Restaurant gave us.
9. Alcohol
Where alcohol is served, the Restaurant's liquor licence conditions and the Liquor Act 59 of 2003 (and applicable provincial liquor legislation) apply. Guests must comply with applicable age and identification requirements, and a Restaurant may refuse to serve alcohol to a person who cannot produce acceptable identification or who appears intoxicated.
10. Non-Discrimination
Restaurants and the platform will not refuse to honour a booking, or refuse service, on a ground that would amount to unfair discrimination under the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 or the Constitution of the Republic of South Africa.
11. Prices and Payments
All prices displayed are in South African Rand and inclusive of value-added tax where applicable.
Card payments are processed by Paystack, a PCI-DSS compliant payment service provider. We do not store your full card details.
Table Deals is the merchant of record for every booking fee payment made through the Website.
Any booking fee or platform charge will be displayed and itemised before you complete payment.
If a payment is declined or later reversed (for example, through a chargeback) after a table has been held or an offer applied, we may cancel the booking and will notify you.
12. Vouchers and Resale
Unless expressly stated otherwise, bookings and promotional benefits may not be resold or exchanged for cash.
13. Force Majeure
Neither we nor a Restaurant are liable for a Restaurant's inability to honour a booking due to circumstances beyond reasonable control, including load-shedding, fire, flood, an occupational health and safety closure, or governmental action, provided that clause 6 (alternative booking or refund) continues to apply.
14. Consumer Rights
The CPA applies where applicable. No term in these Booking Terms is intended to waive any statutory consumer right.
15. Complaints
If you have a complaint about a booking, please contact us at [email protected] in the first instance. If unresolved, you may refer the matter to the National Consumer Commission or an accredited industry ombud, or pursue any remedy available at law.
